Adoption in Florida
Presently, there are about 800 children in foster care in Florida available for adoption.
Florida law does not indicate an age limit to adopting, it indicates an “adult” is allowed to adopt. The main requirements for an adoptive family are background and financial checks, as well as the home study. Another requirement for every prospective adoptive parent before a child can be placed in their home is the Model Approach to Partnerships in Parenting (MAPP) training, a class of 24 to 30 hours to help adoptive parents understand the types of issues they might encounter with an older or special needs child, and to give them some tools to help cope with these situations. The typical time frame is six to eight months for the entire process.
After the application has been approved, the applicants will join a pool of waiting families.
There are several types of adoption open to prospective adoptive parents; domestic infant adoption, domestic older child or special needs adoption and international adoption.
A stepparent may adopt without his spouse joining in the adoption as long as the spouse consents to the adoption. A married person may adopt without the other spouse if the spouse’s failure to consent is excused by the court.
In the case of a special needs child, Florida residency is not required. Florida law prohibits homosexuals from adopting a child. Handicapped people may adopt too, unless the Department of Children and Families determines that the handicap makes him or her incapable of being an effective parent.

There are about 14,000 children in foster care in Florida and about 750 of children waiting for permanent placement are without identified families.
In Florida, persons are eligible for foster parenting if they:
- Are at least 21 years of age
- Consent to criminal and child abuse registry checks
- Are financially able to provide for their present needs and family emergencies
- Permit a health inspection of their home
- Have enough physical space in their home to accommodate children
- Attend required training sessions
- Are willing to meet with a licensing counselor through the Homestudy process to determine if fostering is appropriate for them and their family
- Have a willingness to work in partnership with everyone involved in the child’s life to meet his/her needs
- Are dedicated to helping a child be reunified with his/her biological family or if that is not possible, with an identified adoptive family
- Are single, married, divorced, or widowed
Requirements for foster and adoptive parents also include a Model Approach to Partnership in Parenting course (24 to 30 hours) and in order to become foster parents prospective foster parents must become licensed by completing a licensing study.
